LinkedUp Marketing provides CRM automation, review management, and communication services on behalf of business clients.

In most cases:

Our clients are the controllers of their customer data.

We act as a service provider and data processor, handling personal information strictly in accordance with client instructions.

We do not independently determine the purpose for which client-provided customer data is collected.

4. Client Warranties and Responsibilities

By onboarding with LinkedUp Marketing and providing customer contact data, clients expressly warrant and represent that:

All personal information provided to us has been collected lawfully and in accordance with the Privacy Act 1988 (Cth) and any other applicable laws.

The client has directly engaged or transacted with all contacts provided.

The client has obtained express or inferred consent (where required) for service-related communications, including review requests.

The client has provided customers with a compliant privacy policy disclosing potential follow-up communications.

The client will not upload purchased, scraped, or unlawfully obtained contact lists.

The client remains responsible for compliance with the Spam Act 2003 (Cth) and all applicable marketing and communications laws.

LinkedUp Marketing relies on these representations when providing services.

We are not responsible for verifying the legality of how client data was collected.


5. Electronic Communications Compliance

Where LinkedUp Marketing sends electronic messages (SMS or email) on behalf of clients:

Messages will identify the sending business.

A functional unsubscribe or opt-out mechanism will be included where required.

Opt-out requests will be honoured within a reasonable timeframe.

Clients acknowledge that:

Review requests may be considered commercial electronic messages under Australian law.

The client is responsible for ensuring lawful consent exists before data is supplied to us.


6. Disclosure of Personal Information

We may disclose personal information to:

CRM and automation platforms

Messaging providers

Payment processors

Cloud storage providers

Marketing and analytics services

Professional advisers (legal, accounting)

Regulatory authorities (if legally required)

Some service providers may store or process data overseas.

10. Limitation of Liability

To the maximum extent permitted by law:

We are not liable for indirect, consequential, or incidental damages.

We are not responsible for client misuse of systems or unlawful data collection.

We are not responsible for third-party platform breaches.

We do not guarantee uninterrupted system availability.

Our liability is limited to the total value of services provided in the preceding 12 months.

Nothing in this Policy limits rights under Australian Consumer Law.


11. Data Retention

We retain personal information only for as long as reasonably necessary for business, legal, and compliance purposes.

When no longer required, data is securely deleted or anonymised.
